Their license can be taken away not because they are drunk driving but because they violate the
contract they signed when they apply for driver
license. The contract give police implicit consent
to manage a alcohol level test. If a driver
refuse such a test, he violate the contract
so that his DL can be taken away.
The police has no right to determine a verdict
on drunk driving
